Specifically, soil analyses will occur when the growth <br />medium has been delivered to the site where it will be used, and not in the stockpile location. Previous <br />experience indicates that one composite soil sample for every five acres will be collected and analyzed for the <br />parameters mentioned above. This has been the approved sample frequency, as stated in previous <br />amendments to Permit M -1980 -244. Although difficult to "ensure" the samples are representative of the <br />growth medium materials, past experience and revegetation success indicates CC &V's reclamation practices <br />(i. e. one composite sample for every S acres of reclaimed area) are working. <br />6.4.13 EXHIBIT M — Other Permits and Licenses <br />26. Dam permits — Related to Comment 29c below, if either of the SGVLF Phase 1 or Phase 2 Sediment Ponds is <br />jurisdictional, a permit will need to be obtained from the Office of the State Engineer (OSE). Please clarify <br />whether or not a dam permit will be needed for either sediment pond. (Note: the OSE defines a dam as <br />jurisdictional if it exceeds 10 feet in height measured vertically from the elevation of the lowest point of the <br />natural surface of the ground where that point occurs along the longitudinal centerline of the dam up to the <br />crest of the emergency spillway of the dam). <br />RESPONSE. CC &V appreciates the reminder about OSE requirements. CC &V designs and constructs dams <br />below the 10 feet in height measured vertically from the elevation of the lowest point of the natural surface of <br />the ground where that point occurs along the longitudinal centerline of the dam up to the crest of the <br />emergency spillway of the dam so that dams at the Cresson Project do not meet jurisdictional criteria. The <br />SG VLF Phase 1 and Phase 2 Sediment Ponds are designed and will be constructed so that a permit will not <br />need to be obtained from the OSE. <br />27. Well permits — Please comment on whether new monitoring wells are anticipated for AM -10 and if <br />monitoring wells are to be installed, will they be permitted with the Office of the State Engineer. <br />RESPONSE. No new monitoring wells are anticipated at the Cresson Project for Amendment No. 10. There <br />was no discussion in the Project Description as such. Should additional monitoring wells be determined in <br />the future to be needed, subsequent to approval of the A= Application, CC &V will permit any potential <br />news wells with the OSE. <br />28. Highway 67 relocation — Are Colorado Department of Transportation (CDOT) permits expected for any of <br />the activities associated with the temporary tunnel or other aspects of the highway relocation discussed on <br />page 7 -9 of Exhibit U? <br />RESPONSE. All necessary Colorado Department of Transportation ( "CDOT') permits that would be <br />required to be obtained for activities associated with the temporary tunnel or other aspects of the highway <br />relocation discussed on page 7 -9 of Exhibit U will be obtained from CDOT. <br />6.4.15 EXHIBIT O — Owner(s) of Record of Affected Land (Surface Area) and Owners of Substance to be <br />Mined <br />29.
