All MSIDs as noted were <br />reviewed by CC &V and a revised Exhibit O is included as Attachment 3. All property owners, as noted, <br />received `Notices" and are noted as within 200' ofpermit boundary on revised Exhibit O in Attachment 3. <br />6.4.20 EXHIBIT T — Permanent Man -made Structures <br />30. Owners of land within 200 feet — Pursuant to Rule 1.6.2(1)(g), the Applicant must provide proof of notice <br />to: a) all Owners of Record of the surface and mineral rights of the affected land, and b) the Owners of <br />Record of all land surface within 200 feet of the boundary of the affected lands. The "OMLR Compliance <br />List" at the beginning of the Application (reference page 2, Rule 1.6.2(1)(g)) states proof of notices will be <br />submitted upon receipt of return receipts. The Division has not received these proofs of notice. Please <br />provide copies of the return receipts. <br />RESPONSE: Pursuant to Rule 1.6.2(1)0, CC &V provided proof of notice to: a) all Owners of Record of <br />the surface and mineral rights of the affected land, and b) the Owners of Record of all land surface within 200 <br />feet of the boundary of the affected lands. The "OAMR Compliance List" at the beginning of the Application <br />(reference page 2, Rule 1. 6.2(1)0) states proof of notices will be submitted upon receipt of return receipts. <br />CC &V historically has provided all proof of notices at one time. CC &V provides copies of the Return <br />Receipts in Attachment 7. <br />31. Proposed North Cresson Blasting-- The letter from Matheson Mining Consultants (reference Appendix 5, <br />Volume III) notes the ongoing blasting and monitoring programs demonstrates compliance with blast <br />vibration regulations and precludes damage to sensitive structural elements in homes including historically <br />significant structures. Given the proximity of proposed blasting in the North Cresson (Globe Hill and Schist <br />Island) to the Mollie Kathleen Tourist Mine, the Division is concerned about the effects blasting may have on <br />the Mollie Kathleen underground workings, mine operators and tourists. Please provide the Division <br />assurance that the underground workings and the safety of people in those workings have been considered in <br />the blasting analysis. <br />RESPONSE. As noted above, safety of CC &V workers and the public are of the upmost concern to CC &V. <br />Blast effects will be measured in a conservative manner. Measurement of blast effects on the surface will <br />provide a record of compliance with permit obligations. Current ground vibration criteria that precludes <br />damage to residential and historically significant structures is approximately an order of magnitude lower <br />than ground vibration criteria typically used in underground blasting to preclude rockfall. CC &V intends to <br />measure all blasting. CC& V has had discussions with the owners of the Mollie Kathleen tourist mine and all <br />parties are comfortable in application of the ground vibration criteria set forth in the current CC &V permit. <br />No adverse effect is anticipated; should any occur CC &V will take immediate steps to mitigate the hazard. <br />
