To designate acreage associated with 27 shares that have been <br />dried up, land unencumbered by bonds and owned by Western Fuels was located. <br />A 1960 aerial photo shows an irrigated ranch prior to being mined. This acreage is shown on <br />Map 1A and 1B and shows a total of 109.63 acres. Mining of this acreage probably concluded <br />in the late 1970's. Seventy four acres of this historically irrigated area is shown on Map 1A and <br />is now designated as dried up according to Case No. 88CW55. The remaining 32.93 acres <br />shown on Map 1B are not being used for CU credit at this time. <br />IDENTIFICATION OF LANDS DRIED - UP PER 34 SHARES <br />Western Fuels purchased the mine from Peabody Coal Company and resumed mining in 1993. <br />Since then, parcels have been removed from irrigation as the mine progresses. Some will be <br />reestablished as dry land crops and will not be irrigated in the future. Some of the parcels will <br />continue to be irrigated. The following tables extracted from Table 8 show the acreages that are <br />dried up as of July 2010: <br />DRY -UP ACREAGE USED FOR 34 SHARES <br />DRY -UP ACREAGE NOT USED <br />To establish the beginning of irrigation use for each parcel, the appropriate date of the second <br />water right in the ditch was used. The date was 12/8/1908, so it was assumed that the irrigation <br />started in April 1909. This creates a 101 year period of historic irrigation. Zeros were included <br />6 <br />
