Month
CU for 27 shares,
max of 97.8 of
CU for 34
shares
units
ac -ft
ac -ft
Column
11
12
Total acres
74
71.14
Total shares
27
34
April
3.89
4.83
May
16.88
21.00
June
19.49
24.25
July
20.30
25.26
August
18.54
23.07
September
14.82
18.43
October
3.88
4.83
Total
97.80
121.68
for each year the parcel was not irrigated up to year 2009. The resulting percentage of CU for
the historic irrigation period was shown in the table and applied to the final CU analysis for 34
shares.
Since the two parcels owned by Western Fuels are proposed for dry -land vegetation and they
have control of the land use in the future, those parcels were assigned as dry-up for 34 shares.
The total acreage is 71.14 acres for 91.1% of the full CU credit. These two parcels are shown on
Maps 2A and 3A. The remaining parcels that have been temporarily dried up are shown on
Maps 2B and 3B, and are not being used in the revised augmentation plan. Maps 1B, 2B and
3B are included in this report for illustrative purposes only.
SUMMARY OF CU CREDITS
This table shows the compilation of the dry -up credits and the corresponding CU credits for each
portion of shares. These amounts are fully consumable for industrial, including dust suppression
and domestic use at the mine facilities, and augmentation purposes.
MINE DEPLETIONS
Mining uses could have an impact on both nearby wells and downstream senior surface water
rights. To mitigate these uses, the depletion analysis must quantify the amounts and show the
point in the drainage where the depletion is occurring. Currently, the mining uses are all within
the Tuttle drainage. In Case No. 88CW55, uses were identified in both the Tuttle and Calamity
drainages and replacements were proposed accordingly. The decree identified percentages of
CC Ditch shares that were to be delivered back to the draws in case of a downstream call from
senior water rights. Future depletions in NHN will occur to both the Tuttle and Coal Canyon
draws. Future depletions for the Cyprus area will occur to the Calamity Draw and the San
Miguel River. Table 15 lists the exact monthly depletions, where they occur, and how and
where they will be augmented.
7
