Copies of approved permits and licenses required for the 25 Avenue Site operation will <br />be provided to the Division upon request. <br />6.4.14 Exhibit N — Source of Legal Right to Enter <br />26. The current name is "Cottonwood Land and Farms, LLC ". The name was officially <br />changed, but the Weld County Assessor' s Office still has the name "Cottonwood Land <br />and Farms, LTD ". Therefore, the name on revised Exhibit C -1, Site Layout, Man -Made <br />Structures, and Surface Owners of Record, has been changed to "Cottonwood Land and <br />Farms, LLC" for consistency with the application text. The revised Exhibit C -1 is <br />attached. <br />6.4.18 Exhibit R — Proof of Filing with County Clerk and Recorder <br />27. The date stamped "proof of delivery" transmittal letter for these adequacy review <br />comment responses to the Weld County Clerk to the Board is attached. <br />6.4.19 Exhibit S — Permanent Man-Made Structures <br />28. With the mining cell top of bank setback a minimum of 50 feet from the permit <br />boundary, and a created 3H:1V slope to an approximate lake depth of 20 feet, the setback <br />from the permit boundary for new excavation will be at least 110 feet from the permit <br />boundary. <br />For the M- 2002 -020 permit application submitted in 2002, slope stability analyses were <br />performed by Applegate Group, inc. for continued mining and slurry wall installation at <br />the existing 25 Avenue Site Reservoir. A copy of the slope stability analysis is attached. <br />The lake used to create the existing reservoir and the SW Ponds in the amendment area <br />were mined and partially reclaimed similarly. Mining assumptions and geotechnical <br />conditions at the site have not changed during the last 10 years and, therefore, it is <br />believed that results of the original slope stability analysis are applicable to this <br />amendment. Recommendations from the slope stability analysis include safe mining <br />setbacks of approximately 120 feet from the slurry wall and other man -made structures if <br />mining progresses at a near vertical slope. However, the analysis does not recommend <br />additional setbacks or identify concerns if the mining progresses at a 3H:1V slope from <br />the toe of the existing lake(s) slope. <br />It is believed that the existing lake(s) side slopes are about 3H:1V. If the side slopes are <br />not 3H:1V or flatter, they will be flattened to 3H:1V prior to continued excavation at <br />3H:1V slopes. Even with continued mining at near vertical slopes, the 2002 slope <br />stability analysis found that setbacks near those proposed in this amendment provided <br />protection for the slurry wall and other man-made structures. For creation of the <br />amendment area reservoir, mining will progress at 3H:1V slopes (see commitment in #15 <br />above).
