An examination of the file for this operation, coupled with the <br /> observation of leakage from the active tailings impoundment, <br /> demonstrates that the operator has not, to date, made an effort <br /> to comply with the first of the two stipulations to the permit <br /> as appended. <br /> Contrary to statements made in Recommendation No. 2, Standard Metals <br /> Corporation implemented comprehensive plans for evaluating and controlling <br /> seepage waters occurring at the toe of Tailings Pond No. 4 embankment in <br /> July 1982. Seepage control plans developed for Tailings Pond No. 4 were <br /> formulated in compliance with stipulations promulgated in the NPDES per- <br /> mit issued for the Tail Pond #4 outfalls by the Colorado Department of <br /> Health, Water Quality Control Division. I have submitted all correspon- <br /> dence with the Water Quality Control Division germane to this issue as <br /> enclosures. I apoligize for the fact that your office was not notified <br /> sooner of the status of seepage control plans prepared for Tailings Pond <br /> No. 4, and believe the enclosed information should satisfy your require- <br /> ments.
