STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
August 13, 2012
Ron Thompson
New Elk Coal Company, LLC
122 West First Street
Trinidad, CO 80182
Re: New Elk Mine (Permit No. C- 1981 -012)
Technical Revision No. 66 (TR -66)
Third Adequacy Review
Dear Mr. Thompson:
COLORADO
Q I V I S I O N O F
RECLAMATION
MINING
SAFETY
John W. Hickenlooper
Governor
Mike King
Executive Director
Loretta E. Pineda
Director
The Division has completed a preliminary review of the TR -66 application and has the following comments.
1. Please provide a description on how the proposed Haul Road to the RDA will be used in support of
the post mining land use, as defined in Section 1.04(71), per Rule 4.03. l (f)(i). The Division feels that
in order for the proposed Haul Road to remain post mining, it must provide practical use in
conjunction with its post mining land use.
NECC: Permit Map -15 shows that the road used to access the RDA is an approved part of the post
mining land use. Therefore, no justification is necessary as the road is already- part of the approved
post mining land use.
Division: Response is sufficient.
Please provide a letter from the legal or equitable landowner that would request the
proposed Haul Road to remain left open for further use post mining as required by Rule
4.03. 1 (f)(ii).
NECC: As stated in response to questionl, the road is already an approved part of the post mining
land use and therefore a letter should not be required.
Division: Response is sufficient.
It is unclear on whether the proposed Haul Road design width is appropriate for the overall
size of vehicles and volume of traffic. The typical Remote and RDA Haul Road cross
section found on Map 1 -Sheet 1 shows the Haul Road having a 10 foot minimum width.
Please provide a description on how this width will be suitable for the anticipated traffic or
if additional construction of the Haul Road will be needed to attain appropriate width as per
Rule 4.03.1(3)(c).
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
