COAL <br />COMPANY <br />.' �� rsovocsi°�• 4 <br />b. During the Division inspection on April 18, 2012, it was discovered that <br />Prospect Ditch has a significant bank erosion problem. CCC needs to develop <br />a plan for addressing this erosion. <br />Response: Colowyo is diligently developing a plan for remediation of the <br />section of Prospect Ditch that has been eroded. This area was noted in the <br />2012 Rill and Gully Report submitted on May 2, 2012. When a plan is <br />developed Colowyo will ensure that the Division is notified and able to <br />provide input on the proposed plan prior to implementation. <br />c. Colowyo Coal Company has shown an interest in revisiting the hydrology <br />modeling (TR -95). <br />Regardless of the outcome of this revision, it is a good idea to look at all the <br />surface water hydrology on site, including modeling, design, construction, <br />and maintenance. This is especially true for the watersheds in the East Pit. <br />As stated in RN -05 review, Colowyo and the Division need to work together <br />to bring the on- the - ground conditions into compliance with the hydrologic <br />assumptions in the current, approved permit. This statement continues to <br />be true. This will help to ensure integrity of the current and future <br />reclamation as well as Prospect Pond and the undisturbed areas that lie <br />below the reclaimed lands. <br />Response: Colowyo considers TR -95, addressing the curve numbers (not <br />including Prospect watershed) and sedimentation loading, as addressing the <br />hydrology needs at this time. Colowyo also believes that the work completed <br />between the Division and Colowyo under TR -87, approved March 28, 2011, <br />finalizes all modeling requirements in the East Pit and the Prospect Pond <br />watershed in its entirety. Furthermore, since the recent approval of TR -87 on <br />the ground conditions have not change in the Prospect watershed that would <br />warrant a need to revisit hydrologic modeling once again for that area. <br />Unless the Division is able to provide specific examples on items in the <br />hydrologic modeling that need to be addressed under this renewal Colowyo <br />considers the current approved modeling sufficient. <br />5. Topsoil Removal Plan <br />a. Map 28 Topsoil Handling South Area was updated during MR107, dated April <br />13, 2011.
