DRMS: Please provide a letter from the legal or equitable landowner that <br />would request the proposed Haul Road to remain left open for further use post <br />mining as required by Rule 4.03.1(f)(ii). <br />CIVIL ENGINEERING <br />CONST. MANAGEMENT <br />Re: New Elk Mine Permit C- 1981 -012 <br />Technical Revision Application No. 66, Adequacy Response #1 <br />Haul Road to Refuse Disposal Area (RDA), Change designation of an access <br />road to a haul road, revise DWDA #2 design, Add Employee Parking lot and <br />other miscellaneous drainage revisions <br />On behalf of New Elk Coal Company (NECC), the following responses have been <br />prepared in reply to the Division of Reclamation, Mining and Safety (DRMS') comments <br />and concerns regarding the above referenced technical revision application stated in <br />the letter dated June 29, 2012. <br />1. DRMS: Please provide a description on how the proposed Haul Road to the RDA <br />will be used in support of the post mining land use, as defined in Section 1.04(71), per <br />Rule 4.03.1(f)(i). The Division feels that in order for the proposed Haul Road to remain <br />post mining, it must provide practical use in conjunction with its post mining land use. <br />NECC: Permit Map -15 shows that the road used to access the RDA is an approved <br />part of the post mining land use. Therefore, no justification is necessary as the road is <br />already part of the approved post mining land use. <br />NECC: As stated in response to question 1, the road is already an approved part of the <br />post mining land use and therefore a letter should not be required. <br />3. DRMS: It is unclear on whether the proposed Haul Road design width is <br />appropriate for the overall size of vehicles and volume of traffic. The typical Remote <br />RDA Haul Road cross section found on Map -11 -Sheet 1 shows the Haul Road having a <br />10 foot minimum width. Please provide a description on how this width will be suitable <br />
