The Reclamation Plan Map states there is no overburden to replace; this contradicts the <br />Reclamation Plan which calls for backfilling the pit. The Division defines overburden as <br />earth and other materials disturbed from their natural state in the process of mining. Please <br />clarify this discrepancy and revise the text on the Reclamation Plan Map accordingly. <br />25. The Mining and Reclamation Plan Maps state the Right of Way (ROW) for Thompson Park <br />Rd. is 60 feet. Please clarify if ROW is 60 feet from the center of the road. <br />6.3.6 Exhibit F — List of Other Permits and Licenses Required <br />No comment. <br />6.3.7 Exhibit G — Source of Legal Right to Enter <br />No comment. <br />6.3.8 Exhibit H — Municipalities Within a Two Mile Radius <br />No comment. <br />6.3.9 Exhibit I — Proof of filing with County Clerk <br />26. Due to the amount of time that has elapsed since the application was submitted, please <br />demonstrate that the application is still on file with the local County Clerk and Recorder for <br />public review. If the application is no longer on file, then the Applicant will be required to <br />submit a new copy of the application to the County Clerk and provide the Division with an <br />affidavit or receipt indicating the date it was submitted. <br />6.3.10 Exhibit J — Proof of Mailing of Notices to Board of County Commissioners and Soil <br />Conservation District <br />27. Due to the amount of time that has elapsed since the application was submitted, please <br />provide the Board of County Commissioners and the Soil Conservation District with a new <br />notice of the permit application. Also, pursuant to Rule 1.6.2(1)(a)(ii), please provide the <br />Division with proof of the notices. <br />6.3.11 Exhibit L — Permanent Man -Made Structures <br />28. The Applicant has submitted copies of the damage waiver agreements which were provided <br />to owners of structures within 200 feet of the affected area. The Division has since approved <br />a standardized Structure Agreement form (copy enclosed) which must be used. Please <br />provide all owners of structures within 200 feet of the affected area with the new Structure <br />Agreement forms. <br />
