Brock,

Please see the attached Compliance Advisory from CDPHE regarding the Oxbow March 2012 DMR. The issues raised by
CDPHE are similar to those that we discussed earlier in the following emails. My response to CDPHE will be similar in
that the March 2012 DMR reported the quarterly averaging of the TDS occurring in Jan 2012 and Feb 2012. Otherwise,
there was no discharge occurring in March, 2012.

Jim,

Thank you for your timely response to the Division’s question about the March 2012 DMR.
Your explanation was very clear, however; the Division has one comment. It was unclear in
the initial report that the quarterly average for outfall 016-A was being reported. The
monitoring period on the report is 3/01/2012 to 3/31/2012 and the ‘no discharge’ box was
not marked. This gave the impression that discharge for the month of March 2012 was
being reported.

If this situation should arise again, please make it clear in the report that the quarterly
average is being reported.
