Compliance With Mine Plan N - Support Facilities Not On-site <br /> N -Other N - Special Categories Of Mining <br /> Y -Processing Waste R -Topsoil <br /> COMMENTS <br /> This was Coal Complete inspection of the Elk Creek Mine;DRMS file number C-1981-022 operated by Oxbow <br /> Mining,LLC(Oxbow). I,Jared Ebert of the Colorado Division of Reclamation,Mining and Safety conducted the <br /> inspection. Mr.Jim Kiger with Oxbow accompanied me on the inspection. The weather was sunny and warm <br /> with clouds developing in the afternoon. <br /> AIR RESOURCE PROTECTION—Rule 4.17: <br /> The coal stockpile was in place and the stacking tubes were in operation. There did not appear to be a significant <br /> amount of fugitive dust during the inspection. <br /> AVAILABILITY OF RECORDS—Rule 5.02.4(1): <br /> The mine records were checked at the beginning of the inspection. See the end of this report for details. <br /> BACKFILL and GRADING—Rule 4.14;Contemporaneous Reclamation 4.14.1;Approximate Original Contour <br /> 4.14.2; Highwall Elimination 4.14.1(2)(f); Steep Slopes 4.14.2,4.27;Handling of Acid and Toxic Materials <br /> 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> The Hubbard Creek fan site was inspected;this area has been graded,topsoiled and seeded. The area appeared to <br /> be stable. <br /> EXCESS SPOIL and DEVELOPMENT WASTE—Rule 4.09; Placement; Drainage Control; Surface Stabilization: <br /> The II West Coal Refuse fill was observed. The top of the pile appeared to have been compacted recently with a <br /> sheep's foot compactor. The face of the pile has been topsoiled. The upper portion of pile face had sparse <br /> vegetation established except for some annual cover. The lower portion of the fill slope has good grass <br /> establishment,no significant rills or gullies were observed.
