6. Ihe rights granted by this lease shall include the right to use <br />and remove so much of the surface thereof as shall be reasonably necessary for <br />lessee's operations as herein contemplated. It is understood and agreed that so <br />much of the surface of described premiese as is not required by lessee for its <br />operations may be used by lessor or its tenants for agricultural purposes only, <br />provided that lessee shall not be responsible for any damage to any crops result- <br />ing from its operations hereunder where it has notified lessor of its requirement <br />for any designated portion thereof six (6) months in advance of its actual, opera-. <br />tions thereon. It is further agreed that upon such notice lessor will remove all <br />farm buildings and power lines designated therein within said six (6) months' <br />period. <br />7. The lessee agrees to pay all taxes lawfully assessed against all <br />machinery, tools, equipment, supplies, buildings, improvements and all other <br />property placed by it on the above described lands, and lessor shall pay all taxes <br />lawfully assessed against the real property. <br />8. The lessee agrees to save and keep the lessor harmless of and <br />from all claims and demands of whatsoever kind and character resulting from any <br />act, operation, or negligence of the lessee on the above described lands or in <br />connection therewith. the lessee agrees at all times during the life of this <br />lease to maintain adequate workmen's compensation and public liability insurance <br />for the protection of the lessor. <br />9. Ihe lessee agrees to keep described lands free and clear from any <br />liens arising from its operation and to pay promptly for all labor performed, and <br />for all supplies, material and equipment used or placed on said lands. <br />10. If any indebtedness, including taxes of lessor which may become a <br />lien against the described lands during the term of this lease, should not be paid <br />when due, then the lessee at its option may pay the same in order to protect its <br />rights hereunder; and for all payments so made, the lessee shall be reimbursed by <br />deducting such amounts paid from royalties or payments next becoming due to the <br />lessor. <br />11. Ihe lessee shall not be required to continue operations if and <br />after it determines that said described lands cannot be profitably worked, and in <br />case such determination is made, the lessee shall promptly give notice to the <br />- 3 - <br />
