5 UIZCES
P.O.aw In# Glenwood 3041 s,Co 81802 (970)U5 4958
February 14, 19M
Patricia Nelson
Chief, Industrial Permits&EMoroement Unit
Permits&Enforcement Sect-WQCD
.4300 Chevy Creek Dr. South
Denver, CO 80222-1530
RE: Permit CO-0000396. Coal Basin Mine Site.
Deer Ms. Nelson:
MrW-Continent Resources has received the Amendnrent No. 1 to Permit Co-0000396►which
allows a use of monitoring frequencies at various outfalls at the amine site, in order to
conserve funds for maintenance and reclamation activities- We appreciate Your
oonsidenxtion of our request, and the amendment-
In keeping with the objectives of the amendment, I make the further request that Mk!-
Continent be relieved of the obligation imposed by the Order, issued February 22, 1989,
which required weekly sampling of both inflows to and flaws TSS to 016 theirrtluent$. Since that
, and Flaw,
time, Mid-Continent has taken weekly SaMP1e8 of flaw and in flaw,
TSS and Iron from the effluent. That daft collected indicates seasonal variations
and that TSS and iron are consistently law. We do not believe that the purpose for which
the order was issued, namely to determine solids loading to the ponds, continues as a
relevant concem under the present oi 0.e., cessation of mining).
Also,we did dean the uppermost pond in the fall-of 1995, to remove those sediments which
had accumulated at the conclusion of mining. Phase advise me if You would Ike additional
information in support of this request.
Sincerely,
Diane Delaney
Mid-continent Resources, Inc.
cc: Steve Renner`, DMG
Kathleen Sullivan
