Box 1298
Glenwood Springs,CO 81602
Re: Your letter dated February 14, 1996
CDPS Permit No.: CO-0000396
Pitkin County
Dear Ms. Delaney:
The Division has reviewed your request to relieve Mid-Continent of the weekly sampling of inflows to and outflows
from the Outfa11016 ponds, as imposed by the February 22, 1989,Cease and Desist Order. You point out that
mining has ceased and the uppermost pond cleaned of any accumulated mining-related sediments in 1995.
Examination of the relevant water quality data submitted since 1989 shows no significant compliance concerns.
This compliance record, and the facts that mining has ceased and the pond was cleaned, support that the increased
monitoring is no longer necessary. Therefore, the Division has determined that Mid-Continent has fulfilled the
obligations imposed by Paragraph 8 of the February 22, 1989,Cease and Desist Order. Mid-Continent is now
authorized to immediately resume routine sampling according to the frequencies of analyses specified in their
current permit.
Thank you for your compliance efforts and your interest in conservin-funds for maintenance and reclamation.
Please contact Kathleen Sullivan of my staff,or me,at(303)692-3590,if you have any questions.
Sincerely,
A
Robert J.
