l QtMENT OF TtiR
United States Department of the Interior
x° OFFICE OF SURFACE MINING
Reclamation and Enforcement
Mq y ',aAe Suite 1200
qCH 3 505 Marquette Avenue N.W
Albuquerque,New Mexico 87102 9ECE1VEC,
December 2, 1994
DEC 0 5 1994
Mr. Michael B. Long, Director
Division of Minerals and Geology Division of t'lmerais&beoiog}Department of Natural Resources
215 Centennial Building
1313 Sherman Street
Denver, Colorado 80203
Dear Mr. Long:
Enclosed is a list of material for updating mining and reclamation plans (MRPs) that the
Albuquerque Field Office (AFO) has not received. Please have your staff send the
necessary information or contact the appropriate permittees.
Additionally, during a recent joint inspection, the Office of Surface Mining Reclamation and
Enforcement (OSM) inspector noted that the operator had not submitted an updated
certificate of liability insurance to AFO. A survey of the Colorado MRPs within the AFO
library revealed that most MRPs still contain the original certificates, which are now long
outdated. A review of the computer tracking of material submitted in 1994 revealed that
no Colorado permittees sent AFO a 1994 insurance certificate of liability insurance.
Colorado regulation 2.03.9 mandates that each permittee submit a certificate of liability
insurance "for inclusion in the permit application," which is the MRP, and that the policy be
maintained for the "life of the permit and any renewal thereof." Therefore, each year's
certificate revises the MRP and should be sent to AFO to update our copies. Again,
please have your staff forward the certificates or contact the permittees.
If you have any questions on these requests or the enclosed list, please contact Donna
Griffin at 505-766-1486.
Sincerely,
Thomas E. Ehmett, Acting Director
G Albuquerque Field Office
Enclosure
