Mr. Kevin Riordan
January 13 , 1997
Page- 3
parcels rather than in one transaction.
It is our belief that the net sale proceeds from
remaining unsold parcels in the bankrupt estate will be adequate
to complete payment of reclamation obligations, payment of taxes
and other preferred claims in order to close out the Bankruptcy
Liquidation Plan. It is very important that an arrangement be
worked out that will allay the County' s concerns about payment of
back taxes, and at the same time, give assurance to DMG and USFS
that reclamation monies will be available on a timely basis . To
this end, we request USFS to promptly respond to the open issues
mentioned above . If the exchanges can not proceed within an
acceptable time frame, then the Trustee is obligated to list the
property for private sale, particularly the reclaimed tracts
within the Prep Plant Tract .
If USFS wants to proceed with acquisition of the Prep
Plant Tract, then the Contract should be amended to conform to
present conditions . A meeting at an early date to discuss these
matters would very helpful .
Sincerely,
' MID-CONTINENT RESOURCES, INC.
y Gz
Robert Delan
Vice President
RD/lta
Enclosures
cc : Mr. Michael Long
Mr . Steve Renner
Ms . Cheryl Linden
Ms . Deborath Quinn, for Pitkin County
Mr. Adam Poe
