w <br /> 2 . 0 Purchase Price. The price will be established by <br /> appraisal to be made by a mutually approved appraiser experienced <br /> in the appraisal of mountain real estate, the appraisal to be <br /> performed at the time and under the conditions contained in <br /> Paragraph 6 . 0 hereof . <br /> 3 . 0 Title Conditions . <br /> 3 . 1 Offerors will, within 30 days following execution c= <br /> this Agreement, provide USFS with Title Insurance Commitment issued <br /> by Stewart Title of Aspen to insure title to the amount of the <br /> purchase price, when established, =ncluding copies of recorded <br /> documents not heretofore provided -.which are referenced in the Title <br /> Commitment . <br /> 3 . 2 USFS shall, within 60 days following receipt of <br /> Title Commitment, (the title investigation period) advise Offerors <br /> in writing whether title is acceptable, and if not acceptable, <br /> stating any title correction requirements to mare title acceptable <br /> and USFS shall perform such other investigations as are deemed <br /> necessary to verify that title to the offered 'Lands is acceptable <br /> for acquisition by USFS . <br /> 3 . 3 If USFS advises as to unsatisfactory ti le <br /> conditions , Offerors shall attempt to correct the same, and if nct <br /> corrected within thirty (30) days, then this Agreement shall be <br /> canceled. <br /> 4 . 0 Other Conditions Precedent to Closing. <br /> 4 . 1 USFS shall, within ninety (90) days following <br /> execution of this Agreement perform such other investigations as tc <br /> reclamation, environmental , or other conditions that are dce-ed <br /> necessary by USFS to determine whether the Prep Plant Tract __ <br /> suitable and acceptable for acquisition by USFS , including t:._ <br /> following : <br /> 4 . 1 . 1 USFS will verify whether reclamation to be <br /> performed b,� the Division of Mineral-3 and Gecicav of the State _f <br /> Colorado (DMG; with the funds available and to rbe made ava±_ac_e <br /> under the Uankr.:ctcy Liquidation Plan will be acceptable to USFE <br /> and whet..er such reclamations will be performed within the time an.: <br /> in a manner sat=S-factory to US_'S _ acqulsi:-_en of the '_ rep ::I- <br /> -Tract ; be_. _ e::cressly understood that _his Acreement s <br /> predicated '.:=on =:e a_:7SuT.D ion tnaz such reclaim.at_on w;._! in fac: <br /> occur <br /> 4 . 1 . ?
