Reply Sediment ponds will be left in place if they <br /> will benefit the state, public and the environment. If <br /> { the post mining land use is a ski area, the main parking <br /> lot and facilities could probably use some type of <br /> sediment pond system to insure protection of the environment. <br /> If this program is presently a problem, we will with- <br /> draw the idea and state that all ponds will be removed. <br /> Vol. 7 , Chap. Comment Please describe the parameters that will be <br /> analyzed to determine the fertility status of the <br /> redistributed topsoil and other growth media such as <br /> the scarified road surfaces. <br /> Reply We would appreciate any suggestions that you <br /> might have. Comment The applicant states that size reduction of <br /> the Class I haul roads will be accomplished by moving <br /> the inside ditch out into the road and allowing the cut <br /> to slough behind the new ditch, then during final <br /> reclamation, the remaining 30-40 foot road will be <br /> scarified and revegetated. Since the applicant proposes <br /> to not backfill and grade to approximate original <br /> contour (AOC) , a request for a variance from AOC must <br /> be submitted, including a discussion of the beneficial <br /> effects of the proposed plan and the probable effects <br /> of the alternative to AOC. <br /> In addition, the application states that revegetation <br /> of the road cuts will be done when the cuts stabilize. <br /> Appropriate evidence must be supplied that the road <br /> cuts will all stabilize before final reclamation. The <br /> applicant is advised to develop some alternative for <br /> problem areas, such as buttressing with rock removed <br /> from the rock tunnel development. <br /> The applicant should also clarify whether the portions <br /> of the haul roads that are not on steep slopes such as <br /> the portion of 3 mine road where it passes through a <br /> meadow area will be backfilled and graded to AOC upon <br /> final reclamation. <br /> Reply A formal request for a variance from approx- <br /> imate original contour (AOC) based on steep slope mining <br /> conditions has been submitted.
