Part 5 of the Act, among other things,requires a Colorado discharge <br /> permit for the discharge of pollutants from a point source into state waters. A discharge <br /> permit is required prior to the occurrence of a discharge of pollutants from a point source. <br /> e. "Discharge of pollutants" is defined at§ 103(3)of the Act as follows: <br /> (3) "Discharge of pollutants"means the introduction or addition of a <br /> pollutant into state waters. <br /> f. "Pollutant"is defined at § 103(15)of the Act as follows: <br /> (15) "Pollutant"means dredged spoil, dirt, slurry,solid waste, <br /> incinerator residue, sewage, sewage sludge, garbage,trash, <br /> chemical waste,biological nutrient,biological material, <br /> radioactive material,heat,wrecked or discarded equipment, <br /> rock,sand,or any industrial,municipal, or agricultural <br /> waste. <br /> g. "Point source" is defined at § 103(14)of the Act as follows: <br /> (14) "Point source" means any discernible,confined,and <br /> discrete conveyance, including,but not limited to,any pipe, <br /> ditch, channel,tunnel,conduit, well,discrete fissure, <br /> container,rolling stock,concentrated animal feeding <br /> operation, or vessel or other floating craft, from which <br /> pollutants are or may be discharged. "Point source" does <br /> not include irrigation return flow. <br /> h. SGC undertook mining operations at the Sunnyside Mine for <br /> approximately six years,from 1955 to 1991,although the Mine has operated under other <br /> owners for many decades. <br /> I. SGC has existing discharge permits,Permit Nos. CO-0027529 and <br /> _ CO-0036056,for the discharge of water from the Mine. The water discharges through <br /> the Mine's main access portal,commonly referred to as the American Tunnel portal and a <br /> secondary access tunnel referred to as the Terry Tunnel. The water that is being <br /> discharged consists of water that flows into the workings of the Mine and into the <br /> American Tunnel from surrounding natural fractures and from mining disturbances in the <br /> volcanic rock.
