III. Comments - Compliance <br /> Below are particular issues with regard to any of the above compliance items. Enforcement <br /> actions resulting from failure to comply with the Act, Rules and Regulations, and the permit <br /> also are identified below. <br /> 1) The Operator should keep the Division informed on the construction or remodeling of new <br /> buildings. This is particularly important to determine if any changes are necessary in <br /> the reclamation bond. <br /> 2) Mine No. 3 was discharging during the inspection. There were no visible problems with <br /> the discharge. There was no discharge from the other mines. <br /> 3) Some coal refuse was observed on an area of the old trash pile which had not been <br /> covered with a non-combustible layer. The operator must take the appropriate steps to <br /> ensure that the trash pile and coal refuse are isolated. <br /> 4) Natural woody plant invasion on the abandoned roads and roads used very infrequently <br /> is good. <br />
