Page 2 of 2 <br />Rule 2.04.4 — Cultural Resources Information <br />On 4 June 2012 the Division received a comment letter from the Colorado Historic Society <br />(attached). The letter stated that there has been a block clearance for the longwall panel E4 <br />area and there is a finding of no adverse effect. No additional action is required by <br />Mountain Coal. <br />Rule 3.02.2 — Determination of Bond Amount <br />4. The Division will calculate the reclamation cost estimate associated with the proposed <br />longwall panel E4 MDW's and submit it to West Elk under a separate cover. The Division <br />currently holds a bond in the amount of $15,000,000.00 and the West Elk Mine's current <br />reclamation liability is $14,601,301.00. It is not anticipated that West Elk will be required <br />to submit any additional bond monies as a result of the proposed changes in TR -129. <br />This completes the Division's preliminary adequacy review for the West Elk Mine's Technical <br />Revision 129. Since the Division has no adequacy concerns with the proposed revision, it will <br />propose a decision to approve TR -129 upon completion of the reclamation cost estimate.
