Pineda <br />Director <br />The Division has received the application for West Elk Mine's Technical Revision 129 - Revised <br />Longwall Panel E4 MDW Road and Pad Location. The revision was received on 14 May 2012 <br />and deemed complete on 24 May 2012. The Division has reviewed the submittal and has the <br />following comments. <br />General Comments <br />1. The proposed changes to the MDW drilling plan, as approved in PR -14, includes reducing <br />the length of new road from 4,183 feet to 2,930 feet. This includes changing the access to <br />MDW E4 -3, E4 -4, E4 -11, E4 -14, E4 -16, E4 -17 and E4 -19. The revision also proposes to <br />add a small drill pad for MDW E4 -4 and to change the large drill pad for MDW E4 -16 and <br />E4 -17 and replace it with two smaller drill pads. The proposed changes to the roads will <br />result in a net decrease to the disturbed area of approximately 0.4 acres. The proposed <br />changes to the pad locations will result in no change to the disturbed area. The remaining <br />road and pad locations remain within the polygons approved with PR -14. <br />Rule 2.03.6(1) — Ri2ht of Entry <br />2. On 13 June 2012 the Division received a comment letter from the US Forest Service <br />(attached). The letter stated that the proposed changes were subject to the March 2008 <br />Record of Decision for the E -Seam MDW project and there would be no additional <br />conditions of approval.
