Article 2. PERFORMANCE AND PAYMENT BONDS <br /> The Contractor shall furnish a labor and material payment bond for 100 percent of the original contract price and a <br /> performance bond for 100 percent of the original amount of the contract. The bonds are required by State Law, Title <br /> 24-105,202-203,C.R.S.as amended. The bonds shall be submitted using the State forms. A certified or cashiers check <br /> or bank money order may be accepted in lieu of the bonds. If a surety other than a bond is used,the State will hold fifty <br /> percent(50%)of the surety until the final settlement date and fifty percent(50%)for six(6)months after the final settlement <br /> date. <br /> Article 3. INSURANCE <br /> The Contractor is required to procure and maintain at his own expense the insurance coverage listed below. Proof of <br /> insurance must be submitted on certificates showing the following minimum coverage: <br /> 1. Standard Worker's Compensation and Employer Liability, as required by State Statute including <br /> occupational disease,covering all employees at the work site. <br /> 2. General Liability(Public Liability& Property Damage): <br /> a. Combined single limit of$600,000 written on an occurrence basis; <br /> b. Any aggregate will not be less than$1 million; <br /> C. The contractor must purchase additional insurance if claims reduce the annual aggregate <br /> below$600,000; <br /> 3. Automobile liability(Minimum). The contractor must carry a minimum of$600,000 combined single limit. <br /> The Certificates of Insurance and insurance policies required above shall be subject to the following stipulations: <br /> 1. The State of Colorado MUST be named as an Additional Insured on the certificate of insurance. An <br /> Additional Insured Endorsement amending such policy or policies is also required. <br /> 2. The clause entitled"Other Insurance Provisions"contained in any policy including the State of Colorado <br /> as an additional named insured shall not apply to the State of Colorado. <br /> 3. The insurance companies issuing the policy or policies shall have no recourse against the State of <br /> Colorado for payment of any premiums due or for any assessments under nay form of any policy. <br /> 4. Any and all deductibles or self-insured retention contained in any insurance policy shall be assumed by <br /> and at the sole risk of the Contractor. <br /> 5. If any of the Said policies shall be or at any time become unsatisfactory to the State of Colorado as to the <br /> form or substance,or if a company issuing any such policy shall be or at any time become unsatisfactory <br /> to the State of Colorado, the Contractor shall promptly obtain a new policy, submit the same to the <br /> Principle Representative for approval and thereafter submit a Certificate of insurance as specified above. <br /> Upon failure of the Contractor to furnish,deliver and maintain such insurance as provided above, the <br /> Contract at the sole discretion of the State of Colorado may be immediately declared suspended, <br /> discontinued or terminated. Failure of the Contractor in obtaining and/or maintaining any required <br /> insurance shall not relieve the contractor from any liability under the Contract, nor shall the insurance <br /> requirements be construed to conflict with the obligations of the Contractor concerning indemnification. <br /> 6. Prior to cancellation of or material change in any requisite policy, a minimum of ten (10)days written <br /> notice shall be given to the Principle Representative. <br /> 7. All requisite insurance shall be obtained from financially responsible insurance companies,licensed in <br /> the State of Colorado and acceptable to the State. <br /> 8. Receipt,review or acceptance by the State of all Insurance Policies,Certificates of Insurance and Bonds <br /> required under this Contract shall not be construed as a waiver or relieve the Contractor from hits <br /> obligations to meet the insurance and bond requirements of the Contract. <br /> Bidders are advised to consult with their insurance carrier concerning these requirements. Submit a bid only if <br /> you are prepared to complete these requirements. <br /> Article 4. THREE-WAY AGREEMENT <br /> If a three-way Agreement for Reclamation Activities is required, the Contractor shall enter into a three-way agreement <br /> between the Contractor, the State of Colorado and the private landowner (a sample is included in Appendix 1), and <br /> maintain for the duration of the work, in addition to that specified above,additional insurance coverage of: <br /> Colorado Division of Minerals and Geology GENERAL BID SPECIFICATIONS <br /> June 1, 2002 Page 2 <br />
