In order to determine whether this <br /> certification is acceptable, a full review of previous work submitted for the <br /> satisfaction of Stipulations No. 6 and 8 was undertaken. These stipulations <br /> were essentially identical , with No. 6 directed at the mine portal areas and <br /> No. 8 directed at the haul roads. Deficiencies noted during this more broad <br /> review are detailed below. <br /> Stipulation No. 6 requires, ultimately, a geotechnical and stability analysis <br /> of the proposed backfilled configuration for the five portal benches. Five <br /> test sections were monitored to determine the stability of reclaimed profiles <br /> on unstable areas. However, we can find no place in our records where these <br /> test sections were specifically applied to the reclamation profiles for the <br /> portal bench areas. It should also be noted that on page 32 of Chapter V of <br /> the Permit Renewal Application, the reader is referred to Appendix V-c-1 for <br /> the reclamation profiles of the portal benches. Appendix V-E-1 contains <br /> documentation of the variance from AOC and not the cross-sections used for <br /> reclamation of the portal areas. To summarize, in order to finalize the <br /> reclamation plan for the portal areas, Mid-Continent must: <br /> 1 . clarify where the reclamation profiles for the portal benches are <br /> located within the permit renewal application, <br /> 2. describe how the test sections will be utilized in the final <br /> reclamation profiles for the portal areas, and <br /> 3. demonstrate that the post-mining configuration for the portal bench <br /> area will meet a minimum stability factor of 1 .3. <br /> 215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.(303) 866-3567 <br />
