The Show Cause Order was issued following a <br /> Finding of a Pattern of Violations spanning the period from February 1989 to <br /> January 1990 . As of this date the permittee has requested a vacation of the <br /> Show Cause Order. The Director has determined that a Show Cause hearing will <br /> be held in May, 1991 . The Division and Mid-Continent are attempting to <br /> resolve the matter, as well as a number of related issues by means of a <br /> Settlement Agreement which would be recommended to the Board at the Show Cause <br /> Hearing in May, if such Agreement is achieved by the parties . <br /> Only two stipulations were in effect at the time of Permit Renewal , and these <br /> are still in effect: <br /> Stipulation No. 1 <br /> PRIOR TO REACTIVATION OF MINE NO. 4, THE PERMITTEE MUST CONSTRUCT THE <br /> SEDIMENT PONDS, AS DESIGNED, ON THE SOUTHEAST SIDE OF THE MINE NO. 4 <br /> BENCH. <br /> -4- <br />
