6 . As you are aware, erosion and sedimentation associated with road and mine <br /> bench surfaces and outslopes has been identified as a concern and several <br /> recent Notices of Violation have related to road drainage maintenance. <br /> The Sopris District of the White River National Forest (the <br /> Forest Service) has advised us of their interest in this matter and they <br /> have requested to participate in this midterm review with regard to <br /> stabilization and reclamation measures associated with roads and portal <br /> sites on the national forest. <br /> In order to reach agreement on specific measures which may be necessary <br /> to minimize sedimentation form the roads and portal beaches, the Division <br /> and the Forest Service will conduct a joint inspection this summer when <br /> all areas of the mine are accessible. The purpose of the inspection will <br /> be to i denti fy road or mine bench areas which are contributing excessive <br /> sediment to receiving streams, to identify acceptable options for short <br /> term maintenance and longer term stabilization , and to identify <br /> modifications which may be warranted with regard to decommissioning, or <br /> reclaiming roans to meet final land use objectives . Upon completion of <br /> the inspection, the permi ttee will be required to revise the permit to <br /> address appropriate measures along with a schedule for implementing the <br /> modifications . The reclamation cost estimate will need to be modified <br /> accordingly. <br /> 7 . A number of miscellaneous topics also need to be addressed by this <br /> Midterm Review revision. <br /> a. The Division does not have on file a current certificate of <br /> liability insurance for Mid-Continent Resources. This is necessary <br /> to demonstrate compl iance with Rule 2.03.9( 2) , and needs to be <br /> submitted. <br /> b. Volume 8 , page 4 lists only the three powder magazines as areas <br /> approved for small-area exemption, and this should be updated to <br /> include all currently approved small area exemptions. <br /> C. Map VI I-C-1 in Volume 9 of the permit application should be modified <br /> to include all sediment and surface water control features at the <br /> 1 oadout site, not just the sediment pond. All diversions and <br /> culverts should be included. It is not clear from this map whether <br /> surface water from the eastern and western ends of the disturbed <br /> area is contained by the system. <br /> /er n <br /> 3219F <br /> -10- <br />
