FORMAL PUBLIC HEARING <br />giT-TITIMERTIODUEES, INCORPORATED File No. C -81 -017 <br />201 Centennial Street, Suite 406 <br />Glenwood Springs, CO 81601 <br />All persons wishing to give testimony were sworn. <br />Sec. 10, T1OS, R89W, Pitkin County; underground federal coal mine. <br />Consideration of appeal of Division's decision to approve Technical <br />Revision No. 17, which permits additional facilities to treat water <br />discharged from an underground mine. <br />Mr. Frank Johnson, representing the Division in this matter, referenced <br />EXHIBIT A - a January 11, 1991, request from the Garfield Citizens' <br />Alliance for a formal public hearing. <br />Mr. Randy Cory and Ms. Carolyn Johnson, representing the Garfield <br />Citizens' Alliance, said they felt the citizens were not given an <br />opportunity to participate in some issues regarding this case, <br />particularly in regard to holding an informal conference and having a <br />site inspection. They answered questions from the Board. <br />The Board's council, Mr. Maury Kanizer, discussed the issue of a <br />possible conflict of interest arising for 1 of the 4 Board Members <br />present. He suggested that the Board could continue this hearing to <br />the next Board Meeting, in order to have a quorum for a vote. <br />Ms. Diane Delaney, representing the operator, addressed the Board <br />regarding the issue of a possible conflict of interest and answered <br />their questions. She also discussed the operation briefly. <br />Mr. Frank Johnson said the Division's position is that a possible <br />conflict exits. <br />
