Forest Service personnel <br /> indicate that they approve of this concept for reclaiming the roads <br /> at Coal Basin. <br /> On Monday July 18 , 1994 ,the Office of the Attorney General notified <br /> Mid-Continent Resources that the forfeited bond monies are public <br /> funds as defined by applicable State statute. Because these are <br /> public funds, the Division is obligated to adhere to the Colorado <br /> procurement code when contracting reclamation work at Coal Basin. <br /> This means that the Division, not Mid-Continent Resources, will <br /> contract the reclamation of the mine site. Contracting of the <br /> reclamation projects will be conducted by the sealed bid process <br /> after invitations for bid are sent to perspective reclamation <br /> contractors. Contractors selected to undertake reclamation <br /> projects will post performance bonds with the State, and must <br /> perform to the satisfaction of the Division. These contractors <br /> will be working at the sole direction of the State, as in any <br /> other reclamation project at revoked sites , therefore, Mid- <br /> Continent Resources or its principles will receive no bond <br /> forfeiture funds as payments for reclamation. We have initiated <br /> the contracting process by utilizing the road segment reclamation <br /> plan discussed above to begin development of an invitation to bid <br /> package. <br /> The State is of the opinion that Mid-Continent is legally liable <br /> for any deficiency in the bond proceeds to cover reclamation of the <br /> Coal Basin Mine.
