In that correspondence, Mr. <br /> Lewicki expresses his concern over several aspects of the Sutey <br /> Pile reclamation bid, as well as what he describes as his problem <br /> with me. So that you have all facts available to you prior to <br /> discussing this matter with Mr. Lewicki, I am providing a point by <br /> point response to his concerns. <br /> Regarding the provision of documents, neither Mr. Lewicki nor Mid- <br /> Continent was singled out to not receive the Invitations to Bid. <br /> The Invitation to Bid documents were mailed to some potential <br /> bidders prior to the pre-bid meeting, however the majority of the <br /> contractors obtained their copy at that meeting. The Attorney <br /> General and I have had discussions regarding the provision of <br /> documents to Mid-Continent. It was agreed that documents would be <br /> provided to Mid-Continent as they would to the reclamation <br /> bidders. Further, during the late summer Mr. Lewicki had made a <br /> point of informing other Division staff that he was no longer <br /> associated with Mid-Continent, thus making mailings to him <br /> unnecessary. <br /> As Mr. Lewicki points out, changes to the initial bid document were <br /> made. These changes were discussed during the pre-bid meeting with <br /> the contractors and a representative of Mid-Continent present. The <br /> changes were formalized and sent to all who signed the pre-bid <br /> meeting attendee list. At least twice during the pre-bid meeting <br /> I requested all in attendance to sign in. Apparently, Mid- <br /> Continent did not do so. The changes to the bid document were <br /> mailed from our Denver office to all who were signed in. Special <br /> accommodations for Mid-Continent were not made, primarily because <br /> I assumed that they were on the attendee list. <br /> Regarding landowner notification, it is the policy of the Division <br /> to notify the land owner of the initiation of reclamation work at <br /> permit revocation sites.
