I think that our previous meeting was <br /> very helpful in terms of refining our plans as to how best to proceed with reclamation, <br /> and will anticipate another follow-up discussion prior to the board's March meeting. <br /> I have reviewed your letter, and would like to offer a couple of comments. <br /> • Downslopes below the portal benches: <br /> We indicated in our meeting that we would attempt to establish some vegetative <br /> growth, if possible, on the downslopes, to the extent that such an effort is <br /> consistent with our need to reclaim the site as a whole using available funds. It <br /> must be recognized that the difficulty of access, lack of soil material, and <br /> extremely steep slopes present considerable difficulties. <br /> However, I want to clarify Mid-Continent's position on the matter. We do not <br /> believe that the portal bench outslopes, which pre-date SMCRA and, indeed, <br /> any Colorado reclamation act, were reaffected by our operations post-SMCRA, <br /> or after issuance of the DMG permit, nor do we believe that the law requires us <br /> to reclaim them. <br /> As you well know, our ability to carry out reclamation at the mine site depends <br /> upon the concurrence of our creditors, and will have to be done within the <br /> constraints of money realized from the sale of MCR assets.
