The Division has now reached <br /> a determination regarding reclamation of the mine bench <br /> outslopes. Specifically, we have determined that Mid-Continent <br /> has reaffected these pre-law outslopes in some manner since <br /> enactment of the Coal Statute. Therefore, we have directed that <br /> Mid-Continent revise the reclamation plan to accommodate outslope <br /> stabilization. This work will most likely be accomplished by <br /> spreading sewage sludge on the slopes and then revegetating them. <br /> The Division is also requiring that Mid-Continent construct <br /> catchment basins at the bottom of the slopes in an effort to <br /> minimize sedimentation to adjacent drainages while vegetation is <br /> becoming established. <br /> As the revision process proceeds, and as the construction season <br /> approaches, I anticipate that it will be necessary to utilize an <br /> attorney more intensively. This time commitment will be <br /> especially critical as the Attorney General has been given <br /> explicit instructions from the Board to perform certain actions. <br /> Further, the Division is preparing to reinitiate negotiations <br /> with the major lien holder for this site. Legal representation <br /> at these meetings will be essential. <br /> The Division must be proactive in attempting to resolve the Mid- <br /> Continent problem on all fronts. To do this effectively, we will <br /> need an Assistant Attorney General available on at least a one- <br /> quarter time basis for the next six to eight months. I also <br /> anticipate that there will be short periods of time during this <br /> period when full time attention will be necessary. Assistant <br /> Attorney General Frank Johnson is intimately familiar with this <br /> case. I am requesting that the Department of Natural Resources <br /> discuss our needs with the management of the Office of the <br />
