-2- <br /> 5 . In 1992, 8 Notices of Violation were vacated by either the Board <br /> or Director. In 1993, 4 Notices of Violation have been vacated <br /> by either the Board or Director as of October 20, 1993 . <br /> 6 . The Colorado Rules address redress from Division decisions to the <br /> Mined Land Reclamation Board, not the Office of Surface Mining. <br /> Therefore, we seldom, if ever, refer parties to an oversight <br /> agency rather than the State appellate body. <br /> 7. Colorado has an active program to encourage citizen participation <br /> in the Coal Program. The Division, in 1993, published and <br /> distributed brochures which describes public participation <br /> opportunities. <br /> In 1992 and 1993 the Division has hosted public meetings in coal <br /> mining communities. The Division has actively informed local <br /> media of events related to coal mining which are of interest to <br /> the public. <br /> 8 . The Mined Land Reclamation Board has entered into Settlement <br /> Agreements with operators other than Mid-Continent Resources. <br /> To my knowledge, none of these agreements were court ordered. <br /> 9 . The Colorado Surface Coal Mining Reclamation Act and the <br /> Coal Mining Rules allow the Board to award costs, expenses and <br /> attorney' s fees at the request of any party. <br /> 10 . The Division of Minerals and Geology adheres to the Colorado <br /> Administrative Procedures Act and the Colorado Surface Coal <br /> Mining Reclamation Act in granting status to any interested <br /> person regarding any Division action at coal mining sites. These <br /> articles provide for full participation by interested persons in <br /> all proceedings. <br /> Thank you for your interest in the Colorado Coal Program.
