Chronology - page 2 <br /> - February 1992 - Mid-Continent files a Chapter 11 bankruptcy petition. <br /> - One item in the Settlement Agreement required Mid-Continent to <br /> demonstrate the capability to reclaim the site. The demonstration was <br /> not provided. <br /> - On August 26, 1992, the Board revoked the permit for failure to meet the <br /> terms of the Agreement, and due to the unwarranted failure to comply <br /> with the permit and regulations (1990 Show Cause Order) . <br /> - The Board ordered that the reclamation plan outlined in the Agreement be <br /> implemented. The bond was not forfeited. <br /> - September, 1992 through August, 1993; Division issues 18 notices of <br /> violation to Mid-Continent. <br /> - June/July 1993 - Division approves revision to reclamation plan which <br /> strengthens reclamation requirements. <br /> - Summer, 1993 - Mid-Continent initiates reclamation at Coal Basin: 15 <br /> mine reclaimed; mine facilities removed from 13 mine; refuse pile <br /> contoured, topsoil replacement in progress; various mine structures <br /> demolished; underground storage tanks removed; grading of facilities <br /> area and rock tunnel waste pile initiated. <br /> September 17, 1993 - Division of Minerals and Geology and Attorney <br /> General's Office file suit against Mid-Continent Resources Agents. <br /> September 22, 1993 - Mined Land Reclamation Board forfeits Mid-Continent <br /> Reclamation Bond. <br /> Division of Minerals and Geology <br /> Reclamation Goals <br /> - Minimize continuing erosion and off-site sedimentation. <br /> - Require reclamation which minimizes erosion and sedimentation, and <br /> which maximizes beneficial post-mining land use. <br /> - Coordinate implementation for reclamation with USFS, Office of <br /> Surface Mining, Dept. of Health and concerned citizen groups. <br /> - Revise procedures regarding acceptance of real property bonds. <br /> - Continued inspections of site and enforcement actions. <br /> - Maintain Mid-Continent liability for site. <br /> Contacts: <br /> Steve Renner <br /> Coal Program Supervisor <br /> (303) 866-3567 Ext. 311 <br /> Updated November 3, 1993 <br /> M:\imp\shared\midcon.two <br />
