The underground coal mine <br /> operated from 1954-1991, producing approximately 1 million tons of <br /> coal per year. The mine was permitted under the Colorado Surface <br /> Coal Mine Reclamation Act in 1983. The reclamation permit covers <br /> 11,000 acres of which 430 are disturbed by surface activities. <br /> July, 1990, Division establishes that a pattern of violations exists at <br /> the site due to an unwarranted failure to comply with the terms of the <br /> permit and regulations. Mid-Continent must demonstrate (show-cause) why <br /> the permit should not be suspended or revoked. Pattern of violations <br /> was the result of the Division issuing 6 violations and one cessation <br /> order to Mid-Continent within a 12 month period. <br /> May - October, 1990 - Division issues 6 more violations. <br /> January 1991 - Mid-Continent indicates that it is financially unable to <br /> operate the mine, shuts down operations. <br /> May, 1991 - Division and Mid-Continent negotiate a settlement to the <br /> show cause order (result of pattern of violations) . The Settlement <br /> Agreement wraps in state's and citizen concerns regarding liquidity <br /> (real value) of the rock dust plant and the control of sediment <br /> originating from the mine site. The agreement acknowledges that it is <br /> in the best interest of all concerned to have the mine operated by and <br /> the permit transferred to a financially sound company who could post a <br /> solvent bond. The agreement gave Mid-Continent until January 15, 1992 <br /> to present a successor operator. Failure to supply a successor operator <br /> would trigger implementation of a reclamation schedule. <br /> - Summer, 1991 - USFS/MLR/Mid-Continent inspection results in interim road <br /> stabilization plan submitted by Mid-Continent to minimize <br /> erosion/sedimentation from the road system. Division issues violations. <br /> The Division and the Office of Surface Mining established that the cost <br /> for State to reclaim Coal Basin is $3 million. <br /> Geneva Steel became interested in buying the property in early January, <br /> 1992. They performed various exercises to ascertain the financial <br /> viability of operating the mine. Geneva submitted an application to <br /> succeed to the Mid-Continent permit in late Spring, 1992. At the end of <br /> July, 1992, Geneva withdrew its offer to purchase the mine for economic <br /> reasons. Thus, the reclamation schedule outlined in the May, 1991 <br /> Settlement Agreement became effective. <br /> OVER <br />
