Mid-Continent Resources, Inc. <br /> Carbondale, Colorado <br /> Plan for Sealing of the Dutch Creek, <br /> L.S. Wood, Bear Creek, and Coal Basin Mines <br /> 1.0 Sealing will proceed as expeditiously, as weather and <br /> seasonal conditions, Bankruptcy' Court approval, <br /> availability of funds from the bankruptcy estate, and <br /> authorization, if necessary, by the Colorado Mined Land <br /> Reclamation Division, all as outlined in Mid-Continent's <br /> letter of November 4, 1992, to the District Manager, MSHA <br /> District 9, Denver, Colorado, and incorporated herein by <br /> this reference, will permit. <br /> 2.0 Mid-Continent will petition the U.S. Bankruptcy Court for <br /> authorization to expend funds realized from the sale of <br /> assets from the bankrupt estate for sealing of the L. S. <br /> Wood (No. 3, MSHA ID No. 05-003000) , Coal Basin (No. 5, <br /> MSHA ID No. 05-02342) , Dutch Creek Mine (No. 1, MSHA ID <br /> No. 05-00301) , and Bear Creek (No. 4, MSHA ID No. 05- <br /> 003510) . <br /> 3 .0 Upon approval of the U.S. Bankruptcy Court for <br /> authorization to expend funds and the availability of <br /> such funds, either via asset sales or advances from <br /> creditors, Mid-Continent, via its designated mine <br /> operator, A.M. King Industries, Inc. or via other <br /> qualified contractors, will proceed with sealing the <br /> portals of the mines stated section 2.0. <br /> 4 .0 The sealing of mine portals shall continue on a normal <br /> weekly schedule, Monday through Friday, weather and <br /> seasonal conditions permitting. Due to safety concerns <br /> on steep, rocky slopes, narrow roads, and winter <br /> avalanche dangers, work will be suspended during <br /> inclement weather and winter months when the portals <br /> become inaccessible due to snow cover. <br /> 5.0 All mine openings, with the exception of those <br /> specifically identified below, will be sealed by filling <br /> the openings with 25 feet of incombustible material in <br /> accordance with 30 C.F.R. § 75. 1711.2. Openings will be <br /> filled either using mobile excavating equipment or by <br /> shooting with explosives the immediate mine roof for a <br /> distance of 25+ feet. <br /> The two portals of 2nd South, of the former Dutch Creek <br /> No. 2 Mine (#34 and #35) , can be accessed on foot, and <br /> will be sealed utilizing cinder blocks in accordance with <br /> Section 13 of our last-approved October 19, 1990 <br /> ventilation plan. The lower of these two seals will be <br /> Mid-Continent, Mine <br /> Sealing Plan - 1 - <br />
