Kaplin <br /> Dear Mr. Kaplin: <br /> This is in response to your letter of September 18, 1997, requesting access <br /> across National Forest in the Coal Basin area. Enclosed you will find the <br /> regulations and laws governing this type of use on National Forest System <br /> Lands. Since your letter indicates that you wish to produce and transport a <br /> commercial commodity, you are correct in assuming a special use would be the <br /> correct authorization. <br /> First of all, we can only issue the authorization to the owner of the mineral <br /> estate, therefore, you will need to yet a power of attorney for you to act as <br /> the agent for r_he mineral owner. In addition, you will need to submit a <br /> special use permit application (enclosed) , detailing the kind and location of <br /> access needed. <br /> Regarding your planned operations date of spring 1998, unless you have detailed <br /> engineering and the appropriate environmental studies completed right now, <br /> there is no way we can process your request in that time frame, because snow is <br /> almost upon us. If you plan on occupying National Forest surface to remove <br /> your mineral resource, then we will need to also agree, on the appropriate <br /> surface protection measures necessary. <br /> I would recommend, that you contact Gary Osier (970-625-2371) as soon as <br /> possible, with details of your proposal (including maps) so that he may provide <br /> you with a realistic time frame, and information needed to process your <br /> application.
