Long <br />June 22, 1998 <br />Page - 2 <br />Accordingly, we request that the Division of Minerals <br />and Geology release this property from further reclamation <br />requirements. <br />With respect to the fee property remaining at the Prep <br />Plant site, it is expected that a variety of post- mining uses, <br />primarily recreational in nature will be developed, both for <br />winter and summer use, to commence as soon as completion of <br />reclamation will allow such uses to be carried on safely. In <br />this connection, most of the remaining improvements and <br />facilities will be needed and useful for these post- mining uses. <br />In particular, we refer to the Lamphouse, power line <br />leading to the Lamphouse, roadways through the property, stream <br />crossings, ponds, water wells, water pipeline from Lamphouse to <br />Prep Plant area, remaining building at Prep Plant area. We <br />anticipate discussing these items in more detail with Mr. Renner. <br />The property has been conveyed to Midcon Realty, LLC <br />under the express condition that reclamation be completed in <br />accordance with the approved Plan, with such modifications as may <br />be mutually approved. To this end, the Trustee will retain the <br />balance of the $3,000,000 Reclamation Fund to be used as agreed <br />upon, or in the alternative, to be distributed according to Court <br />Decree. <br />We appreciate the constructive meetings between Mr. <br />Renner and Mr. Lewicki.
