Mr. Michael D. Long
June 22, 1998
Page - 2
Accordingly, we request that the Division of Minerals
and Geology release this property from further reclamation
requirements.
With respect to the fee property remaining at the Prep
Plant site, it is expected that a variety of post- mining uses,
primarily recreational in nature will be developed, both for
winter and summer use, to commence as soon as completion of
reclamation will allow such uses to be carried on safely. In
this connection, most of the remaining improvements and
facilities will be needed and useful for these post- mining uses.
In particular, we refer to the Lamphouse, power line
leading to the Lamphouse, roadways through the property, stream
crossings, ponds, water wells, water pipeline from Lamphouse to
Prep Plant area, remaining building at Prep Plant area. We
anticipate discussing these items in more detail with Mr. Renner.
The property has been conveyed to Midcon Realty, LLC
under the express condition that reclamation be completed in
accordance with the approved Plan, with such modifications as may
be mutually approved. To this end, the Trustee will retain the
balance of the $3,000,000 Reclamation Fund to be used as agreed
upon, or in the alternative, to be distributed according to Court
Decree.
We appreciate the constructive meetings between Mr.
Renner and Mr. Lewicki. In the immediate future, we will detail
issues and suggestions for settlement in the hope that trial of
the pending lawsuit can be averted.
Sincerely,
MID - CONTINENT RESOURCES, INC.
7
Robert Delan
By
Vice Presi
nt
