Long <br />Division Manager <br />Division of Minerals and Geology <br />1313 Sherman Street, Suite 215 <br />Denver, Co 80203 <br />Dear Mr. Long: <br />OFFICE OF GENERAL COUNSEL <br />MID - CONTINENT RESOURCES, INC. <br />June 22, 1998 <br />Re: Coal Basin Reclamation <br />Reference is made to previous meetings and discussions <br />concerning possible settlement of reclamation issues in Coal <br />Basin. <br />The privately owned portion of the Prep Plant tract, <br />the Coke Oven tract, and the Unit Train Loadout tract have been <br />sold by the Bankruptcy Trustee and Mid - Continent Resources, Inc., <br />to Midcon Realty LLC. Deeds are in the process of being <br />recorded. <br />As previously mentioned to you, the Loadout tract has <br />been re -zoned to Light Industrial Uses; the conveyers, equipment, <br />sampling house, loadout facility and other assets not useful or <br />required for post- mining uses have been substantially removed. <br />The Loadout bin structure has been filled with dirt and <br />is being used for covered storage, metal fabrication, and other <br />uses. <br />A plan has been developed for leveling benches to <br />provide more useable land, with the excavated material to be used <br />to fill the cavity on the East end of the Unit Train bin. With <br />the work performed, and to be performed, the property is <br />substantially adapted to post- mining uses. <br />
