This memo is based upon <br />the April 16, 1998 discussion between the parties concerning how a change in ownership will <br />affect ultimate reclamation of the site. The Division understands that if ownership of the lands <br />remains in private hands, the owner might desire to have certain structures remain in place. These <br />structures are detailed in Robert Delaney's April 22, 1998 correspondence. However, ownership <br />may be transferred to the U.S. Forest Service. If this occurs, reclamation would most likely <br />include removal of these structures. Taking into consideration that final ownership of the <br />property is unresolved, this memo provides a description of reclamation plans for the privately <br />held lands. <br />The Division understands that final ownership of the privately held lands may not be determined <br />for some period of time. The Division will remain open to requests for changes to the reclamation <br />plan made by the ultimate owner provided that the requests for changes are made in a timely <br />fashion which allows reclamation to proceed and conclude as expeditiously as possible, and <br />provided that such requests meet applicable reclamation standards. <br />The lands under discussion are roughly bounded on the north by Coal Creek, on the south by <br />Dutch Creek and the Rock Dump, on the west by the Rock Tunnel and on the east by Road A <br />near the former location of the Wash Plant. The eastern most boundary of the privately held <br />property is somewhat vague, in that a land exchange with the Forest Service has recently <br />occurred. This exchange resulted in a shift of the boundary to the west, toward the Wash Plant <br />and Road A. The Forest Service reports that the boundary is at or near Road A by the Wash <br />Plant.
