The 1997 steep slope expenditure, incurred at <br /> exorbitant costs, followed unapproved reclamation practices that <br /> failed on preliminary test plots and demonstratively and <br /> predictably failed on the 1997 applications and will, for the <br /> same reasons, fail in the proposed 1998 applications . <br /> 4 . Objection is :Wade for the =urther reasons <br /> enumerated in Report dated July 21 1998 by Michael Savage <br /> entitled "Revegetation Observations at Mine #5, #3, and #4, Coal <br /> Basin Mines", copy attached. <br /> 5. Objection is further made for reasons stated in <br /> Report dated July 15, 1998 by Gregory E. Lewicki, P.E. , copy <br /> attached entitled "Coal Basin Revegetation Evaluation". <br /> 6 . The exorbitantly expensive deviations from the <br /> approved Plan, together with the repetitive expense incurred by <br /> i, attempted remedi.ation of failed reclamation activities will <br /> exceed the amount of $459, 836 allocated to reclamation under the <br /> approved Plan. <br /> Please further be advised that Mid-Continent Resources, <br /> Inc. and the Trustee will seek an Orde= in the pending Civil <br /> Action No. 97CV131-3, District Court of Pitkin County, Colorado <br /> holding that the expenditures for the seep slope revegetation <br /> work are unauthorized and improper and should be paid from <br /> another fund or disallowed. <br /> Sincerely, <br /> MID-CONTINENT RESOURCES, INC. <br /> By <br /> Robert Delaney <br /> Vice President <br /> ?.ouis M.
