Long <br /> Division Manager <br /> Division of Minerals & Geology <br /> 1313 Sherman Street, Suite 213 <br /> Denver, CO 80203 <br /> Re: Coal Basin Reclamation. <br /> Dear Mr. Long: <br /> For the record, we wish to state our strong objections <br /> to expenditure of funds from the balance of the 53, 000, 000 <br /> Reclamation Fund under the Bankruptcy Liquidation Plan as <br /> disclosed by the Bid Solicitation bearing the project name "Coal <br /> Basin/North Basin Steep Slope Revegetation", Bid No. PKA-9-421 <br /> which provides for bid opening on July 28, 1998 and for work to <br /> be performed in the Fall of 1998 . <br /> In Case No. 97CV131-1 now oeening in the Pitkin County <br /> District Court, we have sought an accounting as to funds <br /> previously expended by DMG from tl:e Reclamation Fund, and as to <br /> future expenditures from that Fund. We will object and request <br /> that the Court disallow steep slope revegegation disbursements <br /> contemplated under Bid No. PKA-9-421, and also as to expenditures <br /> made for similar purposes in 1997 for one or more of the <br /> following reasons: <br /> 1. The expenditures are not included within the <br /> approved Reclamation Plan. <br /> 2 . The expenditures are improper because they involve <br /> reclamation efforts on surface lard disturbances occurring prior <br /> to effective date of the Surface Mine Reclamation Control Act <br /> (SMRCA) , for which reclamation, if performed, should be funded <br /> from Abandoned Mines funding. <br />
