appear to have been eliminated. The slot bin building has been filled to ground level.
Vegetation has been established on the slot bin borrow area, however its effectiveness at
controlling erosion is unknown at this time. The tipple, which was proposed for removal is
believed to still be in place.
When completing the January 23, 1998 reclamation cost estimate, the Division included a cost to
fill the large depression east of the slot bin. This cost was included because it was reasoned that
eliminating the 60 feet wide by 325 feet long by 50 feet deep hole, and creating a flat area would
enhance the approved post mining land use, and possibly increase the value of the property.
Therefore, a cost to accomplish this dirt work, and a cost to provide temporary vegetative cover,
was included in the cost estimate.
Pending an evaluation of the borrow area vegetation, it is probably safe to say that the majority
of the approved reclamation plan for the load out is complete. However, if Midcon LLC and/or
Mid-Continent Resources requests credit for the amount of money estimated in the January 23,
1998 cost estimate, completion of all tasks outlined in that document would need to be
accomplished. This would include completing fill operations at the depression east of the slot
bin, removal of unsold and extraneous scrap materials from the site, and establishment of a
vegetative cover for the purposes of stabilizing the land surface. I would also recommend that
credit be given for the actual expense of completing the required work, rather than for the
estimated cost of doing so.
cc: Jim McArdle
c:\sgr\legal\loadout.wpd
