Unfortunately, the uncertainties created by the pending <br /> litigation do not allow for establishment of a precise time table. A cost to complete each of the <br /> remaining Projects is also included. <br /> Costs are compiled from our January 23, 1998 reclamation cost estimate. I will re-evaluate <br /> certain components of the estimated costs, particularly in relation to the Wash Plant Area Project, <br /> at the first of the year. This may result in a slight change in the estimated cost of that project . <br /> The cost to perform the South Basin Steep Slope Revegetation Project is taken directly from the <br /> price bid by the contractor. A correlation between this price and the January 23, 1998 cost <br /> estimate is difficult to make, as components of two projects contained in the cost estimate are <br /> reflected in the price bid. <br /> It is estimated that we currently hold approximately $240,000 of bond money in the reclamation <br /> account. This estimate should be fairly accurate after all final payments are made for 1998 <br /> construction work. <br /> As you may recall, we are still owed approximately $615,000 from the Trustee. However, it is <br /> safe to assume that we will not receive any of the money owed until the pending litigation is <br /> resolved. It also seems likely that the actual amount paid will be decreased by the value of the <br /> work Midcon LLC is accomplishing at the loadout facility. Due to delays in the litigation as a <br /> result of more filings by Midcon LLC, it is not anticipated that a trial will be held until August or <br /> September of 1999. If the additional funds are provided at that time, it would probably be too <br /> late in the season to initiate any significant project. For planning purposes, it is assumed that the <br /> only money available from the bankrupt estate for 1999 is that which is currently on deposit with <br /> the Treasurer. <br />
