Among other things, the lawsuit claims: <br /> • DMG's reclamation activities in Coal Basin since 1994 have been carried <br /> out in a manner that has incurred expenses far in excess of what is <br /> reasonable. <br /> • DMG has wasted money by, among other things, engaging in <br /> experimental steep slope vegetation attempts and re-vegetating areas <br /> more than once. <br /> • DMG has accepted bids far higher than are reasonable for the work <br /> performed. <br /> Conversely, the Crystal Valley Environment Protection Association <br /> (CVEPA) believes that the reclamation done to date is far from complete and <br /> does not want the project stopped at this time. Further, the CVEPA is <br /> questioning whether or not the reclamation will be adequate even if allowed to <br /> proceed to completion using all available funds. <br /> CVEPA has asked me to provide an independent abbreviated expert <br /> evaluation of various aspects of the reclamation being done at the Mid- <br /> Continent Mine in response to MCR's claims. More specifically, CVEPA has <br /> asked me to evaluate: 1) the cost effectiveness of the reclamation; 2) the overall <br /> 1 <br />
