Owen: <br /> Pursuant to our conversation yesterday,please find enclosed a copy of the settlement <br /> agreement reached in the lawsuit brought by the Board of County Commissioners in Pitkin <br /> County against Mid-Continent Resources. As I mentioned to you yesterday, the Division of <br /> Minerals and Geology was impleaded into the case pursuant to stipulation of the county and <br /> Mid-Continent. Also enclosed is the order in which the Court adopts the agreement as a <br /> court order. <br /> You also inquired about reclamation at the mine site. I mentioned to you that most of the <br /> land is now managed by the U.S.Forest Service, which acquired the majority of the mine site <br /> through land exchanges with Mid-Continent. The only privately owned property is held by <br /> MidCon Realty,LLC. Exhibit B of the settlement agreement summarizes the anticipated <br /> reclamation tasks to be conducted on the privately owned land. <br /> As for anticipated reclamation on publicly owned land at the site,the following generally <br /> describes the tasks intended to be conducted: <br /> Steep Slope Reveaetation <br /> The remaining mine bench outslopes and the out and fill slopes adjacent to the road system <br /> will be revegetated. A contract for this project has already been awarded to an independent <br /> contractor. This project covers approximately 49 acres. <br /> Rock Tunnel Vicinity and Facilities Area Project <br /> In the Rock Tunnel Vicinity,work that remains to be accomplished includes construction of <br /> a permanent diversion channel for the Rock Tunnel drainage into Dutch Creek, demolition <br /> ZO'd ZO:ST 66, S '�30 8SS£998iO�:XPd / <br />
