deepening the drainage and installing a heavy duty liner system with velocity <br /> breaks at discrete intervals to provide a long term solution to transporting the <br /> water down the slope to the receiving ponds. <br /> Mine 5 Revegetation: Mid-Continent reclaimed the Mine 5 area in 1992 or 1993. <br /> The backfill area, a large, steep slope, is not revegetated sufficiently to resist <br /> erosion. Revegetation of this area may be undertaken this year as part of the <br /> Sediment Pond Reclamation Project, or possibly next year in conjunction with an <br /> AML funded Project. <br /> Initial drafts for all of the Projects, excepting Road Reclamation, have been <br /> completed. Please let me know if you would like to review any of the Draft <br /> reclamation plans, and I can provide you with a copy. <br /> have reviewed the Settlement Agreement into which Pitkin County, MidCon <br /> LLC., Mid-Continent Resources and ourselves entered into last year. The <br /> reclamation work which we completed last year substantially fulfilled our <br /> obligations to MidCon LLC. under the terms of the Agreement. The Projects <br /> which we accomplished last year, including Field Modifications to the design <br /> specifications, addressed the reclamation commitments made in the Agreement. <br /> Completion of the Tree Planting Project and of the Sediment Pond Reclamation <br /> Project this year should fulfill our remaining reclamation obligations on private <br /> property. <br /> One remaining issue regarding the sediment ponds remains to be resolved prior <br /> to initiating construction. It is my understanding that the NPDES permit for most <br /> of the ponds remains in effect. We have applied for, and received, a stormwater <br /> permit which now covers all of the sediment ponds on the site, excepting ponds <br /> 017 (Mine 5) and 016 (Rock Tunnel). Mid-Continent has applied for a release <br /> from its NPDES permit obligations at the ponds, however, Water Quality Control <br /> Division has not yet approved the termination. This means that Minerals and <br /> Geology and Mid-Continent Resources are co-permittees so far as the ponds are <br /> concerned. The Agreement states that the Division has the primary responsibility <br /> for the ponds during this co-permittee period. This is not a responsibility which <br /> we wish to shoulder much longer. I have discussed this issue with Water Quality, <br /> but have obviously not made any lasting impression. <br /> would prefer that the Mid-Continent NPDES permit be terminated prior to our <br /> dismantling the discharge structures at the ponds.
