Qivision of Minerals & Geology <br /> Page 2 <br /> It is my understanding that reclamation of the MidCon property has been <br /> completed. I am writing to request that, as provided by the Settlement Agreement, <br /> DMG execute the document described above, releasing the property from any further <br /> reclamation obligation. If further work remains to be done on the MidCon property, <br /> would you please provide MidCon with written documentation as to what remains to be <br /> done, when it will be done, and the estimated cost of completion. <br /> In addition, as provided in the Agreement, would you please advise Lou LaGiglia, <br /> Trustee for Mid-Continent Resources, as to whether reclamation work in Coal Basin has <br /> been completed, whether funds remain, and the amount of remaining funds. <br /> In addition, the Settlement Agreement, at ¶18, provides, in pertinent part, that if <br /> MidCon completes certain reclamation work to DMG's satisfaction, "DMG will execute a <br /> document releasing MidCon .... from further reclamation requirements at the Coal Load <br /> Out " and in turn "Within fifteen days of receipt of such a document, MidCon will execute <br /> and deliver a document to DMG releasing any claim by MidCon again DMG for any <br /> further reclamation work or obligations by DMG at the Coal Load Out. " Settlement <br /> Agreement Page 10. <br /> MidCon would like to obtain, and I am requesting by this letter, the above <br /> described document acknowledging completion of reclamation at the loadout site. <br /> We are, of course, pleased and relieved that the difficult challenges which <br /> confronted DMG, the Mined Land Reclamation Board and Mid-Continent Resources in <br /> getting the former mine site reclaimed have been met and successfully resolved. <br /> MidCon, as property owner, is of course the beneficiary of reclamation and is <br /> appreciative of your efforts to complete work in timely fashion.
