- 6 - <br /> Stipulation No. 2 <br /> THE PERMITTEE MUST CONDUCT A STATISTICALLY VALID REVEGETATION MONITORING <br /> PROGRAM EVERY OTHER YEAR FOLLOWING RECLAMATION OF THE FIRST SECTION OF <br /> THE NEW COAL PROCESSING WASTE EMBANKMENT. EACH ADDITIONAL AREA <br /> REVEGETATED MUST BE INCLUDED IN THE MONITORING PROGRAM DURING THE THIRD <br /> AND SUBSEQUENT GROWING SEASONS. THE SOUTH AND WEST ASPECTS MUST BE <br /> MONITORED SEPARATELY FROM THE NORTH AND EAST ASPECTS PLUS THE FLAT <br /> AREAS. MONITORING MUST CONTINUE ON ALL AREAS REVEGETATED UNTIL EITHER <br /> BOND IS RELEASED OR THE DIVISION APPROVES DISCONTINUATION OF MONITORING <br /> IN WRITING. <br /> IF REVEGETATION MONITORING SHOWS THAT REVEGETATION SUCCESS STANDARDS ARE <br /> NOT BEING MET, AND ARE NOT LIKELY TO BE MET IN SUBSEQUENT YEARS, THE <br /> PERMITTEE MUST MAKE WHATEVER CHANGES IN THE RECLAMATION PLAN THE DIVISION <br /> DEEMS APPROPRIATE AND IMPLEMENT THESE CHANGES IN THE AREAS WHERE <br /> REVEGETATION SUCCESS STANDARDS ARE NOT BEING MET. <br /> With the exclusion of Stipulations No. 4 and 5 this section on vegetation <br /> remains valid for the existing mine site. <br /> XII. Fish and Wildlife - Rules 2.04.11 , 2.05.6 (2 ) and 4.18 <br /> This section remains valid for the existing operation. <br /> XIII. Prime Farmlands - Rules 2.04.12 , 2.06.6 and 4.25 <br /> Tnere is no prime farmland existing on the Coal Basin Mines permit area. <br /> XIV . Operations Description - Rules 2.05.2 , 2.05.3 (1 ), 2.05.3 (2 ) and 4.01 <br /> Tne description of the operation remains valid for the existing operation <br /> except for the fact that the Pock Tunnel has been completed only to the No. 1 <br /> #td No. 2 mines. Further connection of the mines will be accomplished through <br /> lateral extension of the rock tunnel . However, if a demand for No. 3, 4 or 5 <br /> coal were to occur, the haul roads might need to be recommissioned in order to <br /> allow for transport of coal until connection to the Rock Tunnel conveyor could <br /> be made. <br /> XV. Explosives - Rules 2.05.3 (6) and 4.08 <br /> No surface blasting for coal operations is ongoing at the mine site. However, <br /> avalanche control is practiced and requires the use of some explosive <br /> materials. <br />
