Flows are not routed t sediment ponds and are not therefore <br /> discharged through point sources, nor are they routed to ditches, <br /> channels, conduits, wells, etc. <br /> We note the following definition of point source as contained in <br /> the WQCD regulations, and, understand non-point as any source which <br /> is not included in this definition. <br /> § 6.3.0 DEFINITIONS <br /> (31) "POINT SOURCE"' means any discernible, confined, and <br /> discrete conveyance, including, but not limited to, any <br /> pipe, ditch, channel, tunnel, conduit, well, discrete <br /> fissure, container, rolling stock, concentrated animal <br /> feeding operation, or vessel or other floating craft, <br /> from which pollutants are or may be discharged. <br /> We would appreciate a response from the WQCD as to whether those <br /> areas covered by small area exemptions are correctly described as <br /> non-point sources. <br /> Yours truly, <br /> Diane Delaney <br /> Mid-Continent Resources <br /> cc: Dan Mathews, MLRD <br />
