Flows are not routed t sediment ponds and are not therefore
discharged through point sources, nor are they routed to ditches,
channels, conduits, wells, etc.
We note the following definition of point source as contained in
the WQCD regulations, and, understand non-point as any source which
is not included in this definition.
§ 6.3.0 DEFINITIONS
(31) "POINT SOURCE"' means any discernible, confined, and
discrete conveyance, including, but not limited to, any
pipe, ditch, channel, tunnel, conduit, well, discrete
fissure, container, rolling stock, concentrated animal
feeding operation, or vessel or other floating craft,
from which pollutants are or may be discharged.
We would appreciate a response from the WQCD as to whether those
areas covered by small area exemptions are correctly described as
non-point sources.
Yours truly,
Diane Delaney
Mid-Continent Resources
cc: Dan Mathews, MLRD
